Injured In A Rideshare? Here’s What To Know.

Nowadays, rideshares are a part of our daily lives. Most of us have at least one rideshare app on our phone and many of us have driven our cars to earn money as a rideshare driver. And because they are so common, accidents with them happen relatively frequently.

As we’ve outlined in another blog post, there are certain steps you should take if you are involved in any accident. If you are involved in an incident involving a Lyft or Uber driver, whether you are riding in one of their vehicles or are injured by one, there are additional factors that you should keep in mind. First, Lyft and Uber both require their drivers to carry a very comprehensive insurance policy. Second, Lyft and Uber are very wary of the negative press that an accident with an injury could bring to them.

Because of these two factors, you can expect the insurance company to make the argument to you that the driver is really the client – a bluff to make you believe an offer of a small settlement is fair. The reality is their lawyer is going to be negotiating on behalf Uber or Lyft and will do everything possible to protect the rideshare company by minimizing your claim.

What will help you achieve a fair settlement is retaining a lawyer that has experience dealing with Uber and Lyft cases, as well as a lawyer with trial experience. This will be critical to reaching a fair settlement, as the right lawyer will know how to leverage the rideshare company’s position in your favor. Understanding that those rideshare companies are going to be motivated to avoid any negative press can work out in your favor as well.
